7/18/2022 Module 3 Public Release Draft

On July 18, 2022, Dekker/Perich/Sabatini (DPS) and the Community Development Department (CDD) released the third module of the Chapter 16 Development Code update focusing on administration and enforcement for public review. The Development Code is the County’s zoning code, which defines how a property in specific geographic zones can be used and developed. The existing Development Code was adopted in 1965 and has had incremental amendments since its adoption to address issues as they arose. This update is the first comprehensive update of the entire Code undertaken by the County since its adoption. The purpose of the Development Code Update is to align existing land development regulations with adopted County goals and policies, while improving clarity and efficiency. The Code Update will also bring the standards up-to-date by applying measures that reflect contemporary best practices, land use trends, and market demands.

The standards of the Development Code will be updated in a series of three modules. Module 1: Zone District and Use Regulations, released in July 2021, focused on updates to the zone and overlay districts, associated district standards, the use index table, and use-specific standards. Module 2: Development Standards, released in January 2021, reorganized and updated any development standards found in the Development Code including, but not limited to, parking and loading, landscaping, and architecture. Module 3: Administration and
Procedures, this document, focuses on the reorganization and streamlining of content related to administration, enforcement, and procedures. Each module builds off of the previous one. The new content to Module 3 begins on page 144 of the document. This approach creates incremental updates addressing each section separately. Public comments received on each module will be incorporated into the subsequent Module, i.e. public comments on Module 2 were incorporated into Module 3 etc.. This document tracks updates made in response to comments received in Module 2. Content removed as a result of public comments are indicating in this document via text that is struck through (e.g. content removed), while new content added as a result of public comments is underlined (e.g. new content), with the exception of cross-references.

The project team will present the proposed content of Module 3, including public feedback received thus far, to the Planning and Zoning Commission on August 10th  and County Council on August 23rd.
